Where Form I-907 is filed with the additional fee, USCIS undertakes to decide the case within 15 to 45 working days, rather than the standard time that may stretch to many months. It is an important strategic tool for individuals and businesses under time pressure from a job start date, travel plans or an immigration status deadline.
Form I-907 (full name: Request for Premium Processing Service) is a dedicated form for requesting priority processing of certain eligible immigration applications. Unlike other forms, Form I-907 creates no new entitlement — it only speeds up the processing of the underlying application, whether pending or filed at the same time.
Where USCIS accepts a valid Form I-907, it undertakes to take one of the following actions within the prescribed timeframe: approval, refusal, a Notice of Intent to Deny (NOID), or a Request for Evidence (RFE). An important point to remember: the undertaking is about processing time, NOT about the outcome — Premium Processing does not increase the approval rate.
Where USCIS does not act within the undertaken timeframe, the Premium Processing fee is refunded, but the case continues to be processed under the standard procedure. This is one of the features that gives the service its high reputation for reliability.

The timeframe starts from the day USCIS receives a valid Form I-907 — not the day the employer or applicant sends it. Where USCIS issues an RFE or NOID, the Premium Processing clock stops and starts again from the beginning when USCIS receives the response.
“USCIS action” must be clearly distinguished from “final outcome”. Premium Processing undertakes that USCIS will take one of the four kinds of action within the timeframe — including an RFE or NOID. Where an RFE is received, the case still needs further time to respond and await USCIS’s reassessment.
The Premium Processing fee varies by underlying application type and specific category. Notably, USCIS applied a new fee adjustment with effect from 01/03/2026, based on the Consumer Price Index (CPI) for the period from 06/2023 to 06/2025 under the USCIS Stabilization Act.

USCIS undertakes to continue adjusting the Premium Processing fee every 2 years to keep pace with inflation. Applicants should check the latest fee schedule on theUSCIS Filing Feespage before filing, because USCIS will reject an I-907 and refund the fee where the wrong amount is paid.
The Premium Processing fee is paid IN ADDITION TO and SEPARATELY FROM the fee for the underlying application. Where both are filed at the same time, the fees must be paid as two separate amounts exactly as required. The Premium Processing fee is NOT waivable (it does not fall within the fee waiver scheme) even for those in financial hardship.
The right to file Form I-907 depends on the legal relationship to the underlying application:
A little-known rule: even where the worker or a third party pays the Premium Processing fee, the person signing and filing must still be the petitioner. USCIS will reject Form I-907 where the signature is not valid.
There are two common ways of filing Form I-907, each suiting different circumstances:
For an upgrade filing, the applicant must attach a copy of the Form I-797C Receipt Notice for the underlying application and enter the receipt number in the corresponding field on Form I-907. An upgrade filing is NOT permitted where USCIS has already made a final decision on the underlying application.

When filing on paper, the Premium Processing fee is paid using Form G-1450 (credit card), Form G-1650 (ACH transfer from a United States bank), or a business cheque in certain special cases. An important rule: for each underlying application needing Premium Processing, file only one Form I-907. Where a package contains several related applications (for example an I-140 filed together with an I-485, I-765 and I-131), only those eligible for Premium Processing (the I-140 in this case) need their own Form I-907 — no Form I-907 is needed for the I-485 because it falls outside the scheme.

There are several important points about Form I-907 that applicants often overlook:
First, Form I-907 must be completed in full and signed by hand (a handwritten signature). USCIS does not accept a stamped or typed signature — and will return the application with the fee where the signature is not valid.
Second, Premium Processing does NOT give priority within capped categories. In particular, for the H-1B cap, filing Form I-907 does not help a worker be selected in the electronic lottery. Premium Processing applies only after selection and starts from the point USCIS receives the I-129 and I-907.
Third, Premium Processing does not remove the risk of an RFE or NOID. A poorly prepared case may still receive a request for further evidence, and the time undertaking then stops until USCIS receives a complete response. Investing in preparing a high-quality case remains more important than investing in Premium Processing.
Finally, applicants need to remember that Premium Processing only shortens the processing of the underlying application — it does NOT shorten the later steps in the overall process. For example, after an I-129 is approved through Premium Processing, the worker still needs time to obtain a visa interview appointment at the Consulate — a step usually taking a further few weeks to a few months depending on the country.

The Premium Processing fee is not small and cannot be waived, while not every situation calls for faster processing. For cases with a pressing deadline or a risk of losing lawful status, it is a worthwhile investment. Where there is no urgency, spending that budget on careful case preparation or in-depth legal advice usually delivers greater value.
