List of occupations eligible for an LMIA in Quebec

Each year, Quebec’s immigration ministry updates the list of occupations eligible for simplified Labour Market Impact Assessment (LMIA) processing.

This process is intended to help Quebec employers address proven labour shortages by allowing them to recruit foreign workers more quickly.

Because labour shortages in these occupations have been confirmed, Quebec employers need not demonstrate that they were unable to find a worker in Canada to fill the position.

Overview

In general, under theLabour Market Impact Assessment (LMIA)process, Canadian employers must demonstrate that hiring a foreign worker will have a positive or neutral effect on the Canadian labour market and that no Canadian citizen or permanent resident is currently available to fill the position.

The simplified process in Quebec does not relieve the employer of the obligation to apply for an LMIA. For the occupations listed below, however, Quebec employers need not advertise the position for which they are recruiting a foreign worker.

The simplified LMIA process in Quebec

Under the simplified process, employers need not provide evidence of recruitment efforts. Employers are nonetheless expected to make every effort to recruit Canadian citizens or permanent residents before making a job offer to a foreign worker.

Employers must also demonstrate the following:

• The foreign worker meets the education and experience requirements of the job as well as the requirements of theNational Occupational Classification (NOC).
• The hourly wage offered to the temporary foreign worker is consistent with the wage paid to Canadian citizens and permanent residents in the same occupation and geographical area.
• A transition plan is mandatory for all high-wage LMIA applications. Under Quebec’s simplified process, however, a transition plan is required only for a second or subsequent LMIA application for the same occupation and location.

The TFWP pilot project

The Quebec government has broadened eligibility for simplified processing to include certain occupations at NOC skill levels C and D.

From 6 December 2021 to 31 December 2024, certain occupations at National Occupational Classification (NOC) level D are exempt from the advertising and recruitment requirement. The list of these occupations appears below.
