DWUI

DWUI (Driving While Under the Influence) is a criminal offence involving the operation of a vehicle while impaired by alcohol, drugs, or other substances that impair ability.

In Canada, this behaviour is considered a serious violation and often leads to criminal inadmissibility, which may result in an individual being denied entry at the Canadian border, regardless of whether they intend to drive or fly. Within the Canadian legal system, DWUI is similar to offences such as DUI or DWI, and the severity is determined based on Canadian law, particularly if the act is equivalent to an offence with a maximum sentence of at least ten years.

If a person has been convicted of a DWUI abroad and the sentence was completed more than five years ago, they may apply for criminal rehabilitation to remove their inadmissibility to Canada. This process requires documents such as a police certificate, sentencing information, and a processing fee of CAD$1,148.87 for serious criminality.

Processing times range from 6 to 12 months. While waiting, a temporary resident permit may be considered if there is a compelling reason for entry, such as work or family.
