DWAI (Driving While Ability Impaired) is a legal term often used in certain jurisdictions, such as New York State (USA), to refer to driving when one's ability to operate a vehicle is impaired due to the use of alcohol or stimulants. Unlike “Driving Under the Influence” (DUI) — driving while intoxicated with a blood alcohol concentration higher than the legal limit, DWAI applies to cases where the alcohol concentration is lower (typically from 0.05% to under 0.08%) but still affects the ability to drive safely.
In the context of Canadian immigration, understanding DWAI is important because if you have been convicted of a DWAI abroad, this may affect your ability to enter Canada. Canada considers offences related to driving under the influence of intoxicating substances (including DWAI) as serious criminal behaviour, which can lead to the refusal of a visa or permanent resident (PR) status. However, the level of impact depends on the specific laws of the jurisdiction where the violation occurred and the individual's personal record.
